Guardianships

There have been a number of changes to the Guardianship Laws in Massachusetts as a result of the enactment of the Uniform Probate Code. Generally, Guardianships can be sought on behalf of minors whose parents are unable to care for them. A Guardianship may also be necessary for an adult who is incapacitated. A Conservatorship may be sought when it is necessary to make decisions regarding a person's property. Advance planning including drafting such documents such as a Power of Attorney may eliminate or delay the need to seek Guardianship or Conservatorship.
